FEES YOU PAY YOUR LAWYER - suggested questions to clear the air

Before you engage a lawyer you should ask -

  • Are the lawyer's fees negotiable? The fees are not fixed by law and they are like any other commodity. Competition for legal work is fierce. Try a bit of negotiation! If the first firm does not negotiate, try another!

  • Does the lawyer have experience in the type of case you have? Many legal matters require expertise, but that does not mean that you should not negotiate a suitable rate.

  • Is the work charged on the Supreme Court Scale? If so, then ask the lawyer to explain the scale to you and ask the lawyer to justify it. How much on top of the scale will they charge you?

  • Does the lawyer have a different fee structure for different types of work? If so, why is it different? Is there something about your work that requires that higher charge?

  • When will they bill you? What happens if you cannot pay a bill on time?

  • Is the lawyer prepared to show you your file so that you can see what has been happening? It is your file! On occasions you may be surprised how much work has been performed on what may have appeared a simple matter.

  • What is the meaning of 'party / party' costs and what does that mean for me?
